Terms of Service

Welcome to AudiV. These Terms of Service ("Terms") govern your use of the AudiV mobile application (the "App") and the optional backend services that support it — the Family Link sync service running on Cloudflare Workers, the parent-to-kid file transfer running on Google Firebase, and the push notifications routed through Firebase Cloud Messaging (collectively, the "Services"). The App and Services are operated by Runabout Digital ("Runabout Digital", "we", "us").

By installing or using the App, you agree to these Terms. If you don't agree, don't install or use the App.

These Terms supplement (and don't replace) Apple's Licensed Application End User License Agreement that applies to every iOS App Store app, and the analogous Google Play license that applies on Android.

1. License grant

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for personal, non-commercial use, subject to these Terms. The App is licensed, not sold.

You may not:

• Reverse engineer, decompile, or disassemble the App except to the extent that applicable law expressly permits;
• Remove or alter any proprietary notices in the App;
• Sublicense, rent, lease, or commercially redistribute the App;
• Use the App in connection with creating a competing product.

2. User-supplied content

AudiV is a player for audio files you supply yourself. You can import audio files via the system file picker, AirDrop, or the in-app Wi-Fi Transfer feature, and (on parent-mode devices) send them through Firebase Storage to your linked kid devices.

You represent and warrant that, for every file you import or transmit through the App or Services:

• You either own the necessary rights to the file (e.g. it's a public-domain LibriVox audiobook, a DRM-free purchase, your own recording), or
• You have explicit permission from the rights holder, or
• The use otherwise complies with applicable copyright law in your jurisdiction (e.g. personal-use copies of media you've lawfully acquired).

You are solely responsible for the content you import and transmit. Runabout Digital does not pre-screen, review, or moderate user-supplied content, and we are not liable for any infringement, damages, or legal consequences arising from content you handle through the App.

We reserve the right (but not the obligation) to remove content from the Family Link or file-transfer Services if we receive a credible report that it infringes third-party rights — see the DMCA section.

3. The Family Link service

Family Link is an optional feature. When you enable it:

• A 6-character "pairing code" is generated on the kid device.
• A JSON payload containing listening stats, current-playing metadata, device name, an opaque per-install device UUID, and parental control settings is transmitted via HTTPS to our Cloudflare Worker, where it is stored under the pairing-code key in Cloudflare KV.
• Records auto-expire after 7 days of no publishes.
• You can wipe the record at any time by regenerating the pairing code on the kid device or unlinking on the parent device.

Family Link is provided "as available." We don't promise an SLA, real-time delivery, uptime guarantees, or that the Service will be free from delays, errors, or temporary outages. The kid-side cache of parental controls is the source of truth when the network is down — meaning controls already received continue to be enforced even when the Worker is unreachable.

A new pairing code on the kid device makes the old record unreachable to anyone holding the old code; the old record then expires per the schedule above.

4. The Send-a-Book file transfer service

When a parent uses "Send a Book," the audio file is uploaded to Firebase Storage and a small JSON envelope (size, sender device name, recipient pairing code, expiry timestamp) is written to Firebase Realtime Database. The receiving kid device downloads the file, imports it locally, and the cloud copy is deleted by a scheduled Cloud Function within 7 days regardless of whether the kid imported it.

You agree:

• Not to upload content you don't have the right to share;
• Not to use the file-transfer Service for content unrelated to audiobook listening (e.g. malware, executables, non-audio files — the upload pipeline restricts file types but social engineering at the metadata level is your responsibility to avoid);
• That we may impose reasonable rate limits or per-day caps to protect the Service from abuse, and may modify those limits without notice.

We reserve the right to delete uploaded files earlier than 7 days if we receive a takedown notice (see DMCA) or detect abuse.

5. Account-less identity

AudiV doesn't require an account. There is no sign-in, no email, no password. The 6-character pairing code is the only identifier that travels off-device, and it is opaque, randomly generated, and regenerable at any time.

This means:

• We cannot recover or restore data from a lost device — there's nothing tied to "you" on our end to restore from.
• The user holding the pairing code on a parent device is treated as authorized to view the kid device's snapshots and modify its parental controls. Treat the pairing code like a password.
• If your pairing code is compromised, regenerate it from the kid device — the old record orphans immediately.

6. Acceptable use

You agree not to:

• Use the App or Services to harass, harm, or surveil another person without their or their guardian's consent. Family Link is intended for parent-supervised use of a child's own device. Using it to monitor an adult or another household's device without consent may violate local stalking, wiretapping, or privacy laws.
• Probe, scan, or attempt to disrupt the Cloudflare Worker, Firebase backends, or any other Service infrastructure.
• Submit false DMCA takedown notices.
• Reverse engineer or attempt to extract our backend's pairing-code keyspace (the Worker rate-limits and locks accounts exhibiting brute-force patterns).
• Use the App in violation of any applicable law, including copyright, child protection, or export control law.

We may suspend Service access for any account / pairing-code exhibiting violations of this section.

7. Privacy

Our handling of your data is described in detail in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

8. Copyright and DMCA

If you believe content uploaded through the Send-a-Book Service infringes your copyright, send a written notice to dmca@runaboutdigital.com containing:

1. A physical or electronic signature of the rights holder or their authorized agent.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and reasonably sufficient information to permit us to locate the material — for AudiV, this means the pairing code involved and an approximate date of upload, since uploaded files are not publicly addressable.
4. Your contact information (address, telephone number, email).
5. A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on the rights holder's behalf.

We will remove the identified content (within the 7-day retention window — after which it is auto-deleted regardless) and may terminate access for the offending pairing code in cases of repeated infringement.

A counter-notice procedure is available under DMCA §512(g) by emailing the same address.

9. Subscriptions, fees, and in-app purchases

The App is free. There are no subscriptions, no in-app purchases, and no advertising at the time of these Terms. If we ever introduce paid features, those features will be governed by additional terms presented at the time of purchase, and the free features described in these Terms will continue to be available on existing devices on which they were installed.

10. Service changes and termination

We may modify, suspend, or discontinue the App or Services at any time. We'll give reasonable notice for material changes that affect existing users (e.g. shutting down Family Link), but we don't guarantee specific notice periods.

You may terminate these Terms at any time by uninstalling the App and unlinking any paired devices. We may terminate or suspend your access if you violate these Terms or if we discontinue the Services.

The Services rely on third-party providers (Cloudflare, Google Firebase, Apple Push Notification Service) whose continued availability is outside our control. We are not liable for disruptions caused by these third parties.

11. Disclaimers

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

• The App or Services will be uninterrupted, secure, or error-free;
• Family Link snapshots will deliver in real-time or within any particular window;
• Parental controls will block 100% of disallowed playback (e.g. during network outages or in edge cases involving aggressive OS background-task throttling);
• Any data, files, or settings will be preserved if your device is lost, replaced, or has its app data cleared.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUNABOUT DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR SERVICES.

OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP OR SERVICES IS LIMITED TO USD $50.00 OR THE TOTAL AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions don't allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, in which case the above limitations apply only to the extent permitted by your local law.

13. Indemnification

You agree to indemnify and hold Runabout Digital harmless from any claims, losses, or damages (including reasonable attorneys' fees) arising from:

• Content you import, upload, or transmit through the App or Services;
• Your violation of these Terms or applicable law;
• Your violation of any third party's rights, including copyright.

14. Governing law and disputes

These Terms are governed by the laws of [YOUR JURISDICTION], without regard to its conflict-of-laws rules.

Any dispute arising under these Terms shall be resolved exclusively in the courts of that jurisdiction. You waive any objection to jurisdiction or venue in those courts.

If you are a resident of a jurisdiction (e.g. the EU or UK) whose consumer-protection law prevents that choice of law or forum, the mandatory law of your residence applies instead.

15. Children

The App is suitable for all ages, but the parent-side features of Family Link are intended for use by an adult. Children should not configure Family Link without parental supervision. See our Privacy Policy section on children's data.

16. Apple-specific terms

If you obtained the App from the iOS App Store:

• These Terms are between you and Runabout Digital, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide support or maintenance for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any third-party claims relating to the App or your possession or use of it.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Google Play-specific terms

If you obtained the App from Google Play:

• These Terms are between you and Runabout Digital, not Google.
• Google is not responsible for the App or its content.
• Google has no obligation to provide support or maintenance.
• These Terms are subject to the Google Play Terms of Service in the event of any conflict regarding distribution.

18. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. If we make material changes, we'll notify you in-app or via the support email you have on file (if any).

Continued use of the App after a material change constitutes acceptance of the updated Terms. If you don't agree with the update, your remedy is to stop using the App.

19. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy and any additional terms presented at the point of a paid feature, are the entire agreement between you and Runabout Digital regarding the App and Services.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• Waiver. Our failure to enforce a provision is not a waiver.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
